Frequently Asked Questions

When is a Landlord PAN mandatory on a rent receipt for HRA claims?

Under CBDT Income Tax rules, if your annual rent payment exceeds ₹1,00,000 (approximately ₹8,333 per month), it is mandatory to report your landlord's Permanent Account Number (PAN) to your employer to claim HRA tax exemption under Section 10(13A).

When is a Revenue Stamp required on a rent receipt?

Under the Indian Stamp Act, if rent is paid in CASH and the transaction amount exceeds ₹5,000, a ₹1 revenue stamp must be affixed across which the landlord signs. For digital transfers (UPI, NEFT, IMPS) or cheques, an affixed revenue stamp is not strictly mandatory, although having landlord acknowledgment remains essential.

Can I generate receipts for multiple months or quarterly periods?

Yes. You can specify single months (e.g. October 2026) or quarterly billing periods (e.g. Q1 FY 2026-27 / April - June) based on your employer's HR payroll submission guidelines.

Everything salaried taxpayers must know to claim Section 10(13A) House Rent Allowance tax exemptions without employer audit rejections.

When is Landlord PAN Mandatory?

Under CBDT Circular No. 08/2013 and Rule 26C of Income Tax Rules, clear monetary thresholds dictate documentation requirements:

• Annual Rent up to ₹1,00,000 (₹8,333/month): Landlord PAN is not mandatory. Monthly rent receipts alone suffice.

• Annual Rent exceeding ₹1,00,000: Landlord PAN is legally mandatory. If the landlord does not possess a PAN, they must execute a declaration in Form 60 along with identification proof.

• Monthly Rent exceeding ₹50,000: The tenant must deduct 5% TDS under Section 194-IB from the rent paid to the resident landlord and deposit it using Challan-cum-statement Form 26QC.

When is a Revenue Stamp Required?

Under the Indian Stamp Act, acknowledgment of cash money transactions carries specific stamp duties:

Cash Rent Payments over ₹5,000: A ₹1 revenue stamp must be affixed across which the landlord signs (crossing the stamp).

Digital Bank / UPI / Cheque Transfers: A revenue stamp is technically not mandated by law because electronic bank statements serve as irrefutable digital audit proof of fund transfers, although many corporate HR departments still request signed receipts for their personnel files.

Paying Rent to Parents: Can You Claim HRA?

Yes, you can legally claim HRA exemption by paying rent to your parents, provided: (1) The residential property is owned legally in your parents' name (not yours); (2) You transfer rent via verifiable banking channels (NEFT/UPI/Cheque); and (3) Your parents report this rental income under "Income from House Property" in their own annual Income Tax Return (ITR). However, you cannot claim HRA by paying rent to your spouse, as husband and wife are legally viewed as cohabiting partners.

AIS Matching: The Income Tax Department actively cross-verifies HRA claims against the landlord's Annual Information Statement (AIS). Ensure landlord PAN details match tax records perfectly.
